Circle — Terms of Use

1. What Circle is

Circle is a personal relationship manager. It helps you remember the people who matter to you, their birthdays, what you talked about and when to reach out again. It works on your iPhone, with data that stays on your iPhone. How your information is handled is described in the Privacy Policy, which is part of these terms.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Circle on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, distribute, sell, rent, reverse-engineer or create derivative works from the app, except where the law expressly allows it.

3. Your content

Notes, interactions, reminders, cadences and the list of people you mark as important are yours. We do not access them, claim any rights over them, or store them anywhere other than your device. You are responsible for what you write and for keeping a backup if you need one; the app offers an export in Settings, and iOS backups include the app's data according to your settings.

4. Your Contacts and other people

Circle reads your address book only with the access you grant, and only the contacts you allow. You are responsible for using information about other people in a lawful and respectful way. Circle does not send messages, e-mails or calls on your behalf: it may open the system composer with a draft, and the decision to send is always yours.

5. Acceptable use

You agree not to use Circle to:

• store or process information about other people in ways that violate their rights or applicable law;
• harass, stalk or send unsolicited communications;
• interfere with, damage or attempt to gain unauthorized access to the app or to Apple's services;
• use the app for any unlawful purpose.

6. On-device suggestions

Where available, Circle can generate text suggestions using Apple's on-device models, based only on the facts you select. Suggestions are drafts: review them before use. We do not guarantee their accuracy or suitability, and they never represent a statement about a real person's life or relationship with you.

7. Availability and changes

We may update, change or discontinue features of the app. Features may depend on your device, iOS version and the permissions you grant. Because Circle stores data only on your device, discontinuing the app does not delete your data; you can export it at any time.

8. No warranty

Circle is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. In particular, reminders and notifications depend on iOS and on your device settings; we do not guarantee that a notification will be delivered at a specific time.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, arising from your use of or inability to use Circle. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months preceding the claim.

10. Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claim relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Where these terms conflict with the App Store Terms of Service or Apple's Licensed Application End User License Agreement, Apple's terms prevail to the extent of the conflict.

11. Termination

You may stop using Circle at any time by deleting it from your device, which deletes its local data. We may terminate the license if you materially breach these terms.

12. Governing law

These terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules, and subject to any mandatory consumer protection rights in your place of residence.

13. Changes to these terms

We may update these terms when the app changes materially — for example, if paid features are introduced. The current version, with its effective date, is always available inside the app and at the public link listed in the App Store.
